Artificial Intelligence

The increasing prevalence of technologies and products that use artificial intelligence (AI) brings with it many emerging legal needs for businesses that develop, utilize, or interact with AI technologies. The stakes for successfully navigating these legal issues are rising as governments across the U.S. and globe adopt and implement complex compliance regimes regulating the development and use of AI technologies.

The Artificial Intelligence Group at Davis Graham & Stubbs LLP is a multidisciplinary group of lawyers whose collective technical, legal, and business expertise enables them to help businesses identify and address the varying AI-related technical, legal, and risk management needs presented in this emerging regulatory landscape. Such AI-related needs may include:

  • Protecting and licensing intellectual property rights
  • Establishing policies and protocols to comply with new legal regulations governing the development and use of AI technologies, including those addressing disclosure to consumers and prevention of bias
  • Addressing data privacy and data use considerations
  • Addressing cybersecurity best practices
  • Implementing appropriate contract terms with vendors and partners to manage risks associated with third-party use of AI
  • Handling acquisitions, financings, investments, and other transactions involving companies with AI technology and assets
  • Handling litigation arising out of complex commercial or intellectual property disputes related to AI
  • Establishing appropriate employment policies and practices when implementing AI-related HR technology

After passage of the EU AI Act, the first (and so far, only) U.S. jurisdiction to adopt comprehensive AI regulation was Colorado, which enacted in May 2024 Senate Bill 205, Consumer Protections for Artificial Intelligence. DGS lawyers advised industry groups and clients and interacted with lawmakers throughout the Colorado legislature’s consideration of this bill. The deep knowledge the DGS team developed is now benefitting clients seeking guidance on how to prepare for and comply with this first of its kind legislation.
