Case Study: Water Transfer Litigation

As co-counsel for the Northern Colorado Water Conservancy District, DGS attorneys successfully represented the District as an objector in City of Thornton v. Bijou Irrigation Co., 926 P.2d 1 (Colo. 1996), the largest water transfer case in Colorado history.  This litigation involved multiple complex water rights issues, including change of agricultural water rights, transmountain diversions, exchanges involving Colorado-Big Thompson water, statutory notice requirements and numerous other issues unique to Colorado state water rights laws and principles.   The results in this case laid the foundation for the client's future water planning, development and use goals.
