Case Study: Citizen Suit Defense
We represented an oil company in connection with a RCRA citizen suit notice served by a local school district alleging that the gasoline additive methyl-tertiary-butyl-ether (MTBE) had leaked from the company's underground storage tanks into the drinking water supply of the school. A local church also claimed that its water supply had been impacted by the MTBE contamination. The source of MTBE contamination was unclear, given the presence of MTBE in deep wells in the area but not shallow wells. Research revealed that the source of MTBE could have been tanks that leaked years ago on the school's property. We successfully settled the matter by negotiating a settlement which resulted in both the school district and oil company working together to install a new well for the church.
