Case Study: Shopping Center
We represented Westview Partners in the sale of a shopping center with leaking underground storage tanks and in its application for reimbursement to the Petroleum Storage Tank Fund related to a release from tanks owned and installed by its tenant. We were successful in qualifying our client as an “innocent property owner” eligible to receive 100% reimbursement of its cleanup costs and in structuring an escrow to manage payment of ongoing cleanup costs to be incurred after the sale.
